2011 Bargaining Update #8

July 7, 2011

On July 7, 2011, the CSUEU bargaining team finished three days of contract negotiations with representatives of the CSU at the Chancellor’s Office.

CSUEU countered (in bargaining, “countered” is used when one side passes an article that has been discussed once or more in earlier sessions):

The CSU countered:

The CSU also withdrew Article 16, Leaves of Absence without Pay (they had “sunshined” this article but never passed a proposal)

The CSU is still refusing to grant a temporary contract extension. Overall, with a few exceptions, the CSU is obligated to continue the terms and conditions of the expired contract.

The exceptions are:

1. The arbitration provision does NOT survive the expiration of the agreement. Therefore, grievances dealing with events that arise after June 30, 2011, will not be subject to arbitration.

2. In the absence of a collective bargaining agreement, the federal Fair Labor Standards Act (FLSA) requires that all overtime hours worked by non-exempt employees be compensated in cash.

These are the only impacts resulting from the expiration of the contract.

Following are the remaining scheduled sessions:

  • CSU Long Beach 7/13 - 7/15

It is unlikely that we will have the contract resolved by the conclusion of bargaining next week in Long Beach. The following dates have been tentatively scheduled:

  • CSU Dominguez Hills 8/17 – 8/19
  • Chancellor’s Office 9/7 - 9/9
